These Terms and Conditions apply to any product, service or solution (the “Product”) that you purchase directly from RAZ Mobility, LLC (“RAZ Mobility”).
You may cancel your order, and receive a full refund, if your Product has not yet been shipped by RAZ Mobility to the shipping address. After the Product has shipped, the Return Policy applies.
RAZ Mobility reserves the right to refuse to fulfill an order for any reason. RAZ Mobility may not fulfill orders that include a “ship to” address outside of the United States or Canada.
RAZ Mobility does not guarantee that your order will be delivered to the designated address within any specific period of time. The shipping speed provided on the RAZ Mobility website or by RAZ Mobility staff is an estimate. Shipping speeds will vary depending on a number of factors, including inventory availability and the shipping address.
Risk of loss for shipments from RAZ Mobility to the customer’s shipping address shall pass to the customer after the shipping carrier indicates that the order has been delivered to the shipping address and any person at that address (including family members, friends or guests) has signed for the order.
Risk of loss for shipments from the customer to RAZ Mobility (such as in the case of returns, repairs or warranty claims), shall pass to RAZ Mobility after the shipping carrier indicates that the shipment has been delivered to RAZ Mobility’s correct address. Except that in cases where RAZ Mobility provides the shipping label, and you use that shipping label, the risk of loss transfers to RAZ Mobility as soon as you provide the package to the shipping carrier.
If your Product is damaged and the damage is not covered under the RAZ Mobility Warranty Policy, you must ship the Product back to the following address:

You must include in the package (i) the Product you wish repaired, (ii) your name, (iii) a contact phone number, (iv) email address, if available, and (v) a brief description of the damage you have experienced. After diagnosing the Product, a customer service representative will contact you and inform you of whether the Product can be repaired, provide you with the cost of the repair (the “Repair Fee”) and obtain your authorization to proceed with the repair. If repair is not possible, RAZ Mobility will provide you with the cost of a replacement and request your authorization to proceed with replacement. In either case, RAZ Mobility will charge your credit card the quoted amount, and ship your repaired or replacement Product to the address you provided. In the event that your Product is replaced, your original Product will become the property of RAZ Mobility.
Repair or replacement services include the following fees:
RAZ Mobility provides repair or Warranty services without an obligation to ensure that any personal or other confidential information on the device is kept confidential. You are responsible for backing up (to the extent possible) and deleting all such information on your device before sending it to RAZ Mobility, and assume all risk in failing to do so. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAZ MOBILITY WILL NOT BE LIABLE FOR ANY LOSS OR INJURY IN CONNECTION WITH INFORMATION STORED ON YOUR PRODUCT OR TO WHICH YOUR PRODUCT MAY GAIN ACCESS, INCLUDING UNAUTHORIZED DISCLOSURE OR MISUSE OF SUCH INFORMATION. RAZ Mobility reserves the right to delete all information left on Products in our possession without liability to you. Further, Products returned to you after repair or replacement may not contain the personal and confidential information that was contained on the Product when it was first received by RAZ Mobility. RAZ MOBILITY WILL NOT BE LIABLE FOR ANY LOSS OR INJURY IN CONNECTION WITH INFORMATION THAT WAS STORED ON YOUR DEVICE AND DELETED WHILE IN RAZ MOBILITY’S POSSESSION.
With respect to the RAZ Memory Cell Phone, you agree that by purchasing this product, you have the consent and/or legal authority to access the user’s information, including but not limited to, call history, contacts, and the location of the phone.
The RAZ Memory Cell Phone, MiniVision2+, and SmartVision 3, are 4G devices that will work on the 3G and 4G networks of the applicable wireless providers. The devices do not support 5G. Wireless service is purchased separately.
The Products do not guarantee your safety. We make no claim that the Products will work effectively in case of an emergency. The Products are not a replacement for any current emergency, automated emergency or other emergency system, hardware or software. RAZ Mobility is not responsible whatsoever for any damages, whether to the body or to property, that result from the fact that the Product did not work properly during an emergency.
RAZ Mobility’s trademarks may not be used in connection with any product or service that is not RAZ Mobility’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits RAZ Mobility. Further, you may not alter, obscure, or render unclear any trademark, logo, or other notice that indicates the rights of RAZ Mobility with respect to any trademark, whether built into, printed on packaging or promotional material, published online, or otherwise.

Any dispute or claim relating in any way to your purchase or use of any Product will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.
There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow these Terms and Conditions as a court would.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to RAZ Mobility, 1934 Old Gallows Road, Suite 350, Tysons Corner, VA 22182. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes. The AAA’s rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. RAZ Mobility will not seek attorneys’ fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.
We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
NEITHER RAZ MOBILITY NOR ITS LICENSORS IS RESPONSIBLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM USE OF THE SOLUTION PROVIDED BY VOICEITT, INC. (THE “VOICEITT SOLUTION”), USE OF THE PRODUCTS, OR ANY BREACH OF THESE TERMS AND CONDITIONS, WARRANTY POLICY, RETURN POLICY OR PRIVACY POLICY, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; LOSS OF, DAMAGE TO, COMPROMISE OR CORRUPTION OF DATA; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING, ANY COSTS OF RECOVERING, PROGRAMMING, OR REPRODUCING ANY DATA STORED IN OR USED WITH A PRODUCT OR THE VOICEITT SOLUTION.
THE LIMITATIONS OF LIABILITY CONTANED WITHIN THIS SECTION IN NO WAY DIMINISH OR NULLIFY LIMITATIONS OF LIABILITY CONTAINED WITHIN OTHER PROVISIONS OF THESE TERMS AND CONDITIONS.
IF YOUR STATE OR PROVINCE DOES NOT ALLOW LIMITATIONS TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS, SUCH LIMITATIONS DO NOT APPLY TO YOU. SOME CANADIAN PROVINCES MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
By purchasing Products, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Maryland, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and RAZ Mobility.
These Terms and Conditions apply to the RAZ Emergency Service offered by RAZ Mobility, LLC (“RAZ Mobility”).
If you are purchasing the RAZ Emergency Service on behalf of someone else, you represent and warrant that you have the authority to do so and that you can accept and agree to these Terms and Conditions on their behalf.
You represent and warrant that you own all right, title, and interest in and to the data, content, or other materials (“End User Content”) that you provide to RAZ Mobility for the purpose of providing the RAZ Emergency Service. By uploading the End User Content or allowing RAZ Mobility and its subcontractors to access such End User Content, you hereby grant and will grant RAZ Mobility and its subcontractors a nonexclusive, worldwide, royalty free, fully paid up, transferable, and sublicensable license to use, copy, display, upload, perform, distribute, store, modify, and otherwise use the End User Content for the limited purpose of providing the RAZ Emergency Service.
The maximum number of calls that you can place to the RAZ Emergency Service each calendar month is twenty. Emergency calls placed beyond this number will be forwarded directly to 911.
THE RAZ EMERGENCY SERVICE IS FURNISHED AS IS, WHERE IS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.
IN CONSIDERATION FOR RECEIVING THE RAZ EMERGENCY SERVICE, YOU RELEASE FROM LIABILITY AND WAIVE YOUR RIGHT TO SUE RAZ MOBILITY AND ITS EMPLOYEES, OFFICERS AND SUBCONTRACTORS (COLLECTIVELY, “PROVIDERS”) FROM ANY AND ALL CLAIMS, INCLUDING THE PROVIDERS’ NEGLIGENCE, RESULTING IN ANY PHYSICAL INJURY, ILLNESS (INCLUDING DEATH) OR ECONOMIC LOSS THAT YOU MAY SUFFER IN CONNECTION WITH THE RAZ EMERGENCY SERVICE.
You will not engage in, attempt to engage in, or permit or assist others in engaging in, any of the following prohibited activities: (i) use any software, script, code, device, crawler, robot, or other means not provided by Company or its subcontractors to access the RAZ Emergency Service; (ii) circumvent, disable, or otherwise interfere with security-related features on the RAZ Emergency Service; (iii) modify, adapt, translate, reverse engineer, decipher, decompile, or otherwise disassemble any portion of the RAZ Emergency Service; (iv) access or use the RAZ Emergency Services in any manner that may damage, disable, unduly burden, or impair any part of the RAZ Emergency Service, or any servers or networks connected to the RAZ Emergency Service; (v) interact with the RAZ Emergency Service in a manner which is fraudulent, libelous, abusive, obscene, profane, harassing, or illegal; (vi) use the RAZ Emergency Service for any illegal purpose or in violation of any law, statute, rule, permit, ordinance or regulation; (vii) gain or attempt to gain unauthorized access to the RAZ Emergency Service; (viii) interfere or attempt to interfere with the RAZ Emergency Service provided to any user or network, including, without limitation, via means of submitting a virus to the RAZ Emergency Service, spamming, crashing, or otherwise; (ix) engage in commercial use or distribution of the RAZ Emergency Service, or copy or create any derivative work of the RAZ Emergency Service; (x) use the RAZ Emergency Service in any way that infringes or misappropriates any third party’s rights, including intellectual property rights, copyright, patent, trademark, trade secret, or other proprietary rights, or rights of publicity or privacy; or (xi) use the RAZ Emergency Service for the benefit of any third party.
If you purchased an annual subscription to the RAZ Emergency Service and you return the RAZ Memory Cell Phone within the 20-day return period, you will receive a refund of $90.00 on the annual subscription amount and your RAZ Emergency Service will be cancelled. If you purchased a monthly subscription of the RAZ Emergency Service and you return the RAZ Memory Cell Phone within the 20-day return period, you will not receive a refund for payments made for the RAZ Emergency Service, however the RAZ Emergency Service will be cancelled.
You may cancel your RAZ Emergency Service at any time, however you will not receive a refund for payments already made for the RAZ Emergency Service except as provided in the paragraph above titled “Refund Policy”.
By purchasing the RAZ Emergency Service, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Maryland, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and RAZ Mobility.
Refunds are not provided to purchased music sessions.
Scheduled sessions must be cancelled with at least 48 hours prior notice. Notice can be provided by either email or phone call. Customers are permitted to miss, without providing the required notice, one (1) out of four (4) purchased music sessions without penalty. If a customer misses additional sessions without cancelling 48 hours in advance, however, the customer will not have the opportunity to reschedule, and will not receive a refund for the missed session(s).
These Terms and Conditions apply to the solution offered by Voiceitt, Inc. (the “Voiceitt Solution”), and are in addition to the Terms and Conditions that apply to any Product.
If you are purchasing the Voiceitt Service on behalf of someone else, you represent and warrant that you have the authority to do so and that you can accept and agree to these Terms and Conditions on their behalf.
CONTENT AND DATA
You represent and warrant that you own all right, title, and interest in and to the data, content, or other materials (“End User Content”) that you provide to RAZ Mobility for the purpose of providing the Voiceitt Solution. By uploading the End User Content or allowing RAZ Mobility and its subcontractors or licensors to access such End User Content, you hereby grant and will grant RAZ Mobility and its subcontractors and licensors a nonexclusive, worldwide, royalty free, fully paid up, transferable, and sublicensable license to use, copy, display, upload, perform, distribute, store, modify, and otherwise use the End User Content for the limited purpose of providing the Voiceitt solution and for any additional uses for which you have provided your consent.
WAIVER OF LIABILITY
IN CONSIDERATION FOR RECEIVING THE VOICEITT SOLUTION, YOU RELEASE FROM LIABILITY AND WAIVE YOUR RIGHT TO SUE RAZ MOBILITY, ITS LICENSORS AND THEIR RESPECTIVE EMPLOYEES, OFFICERS AND SUBCONTRACTORS (COLLECTIVELY, “PROVIDERS”) FROM ANY AND ALL CLAIMS, INCLUDING THE PROVIDERS’ NEGLIGENCE, RESULTING IN ANY PHYSICAL INJURY, ILLNESS (INCLUDING DEATH) OR ECONOMIC LOSS THAT YOU MAY SUFFER IN CONNECTION WITH THE VOICEITT SOLUTION.
RESTRICTIONS
You will not engage in, attempt to engage in, or permit or assist others in engaging in, any of the following prohibited activities: (i) use the Voiceitt Solution for any illegal purpose or in violation of any law, statute, rule, permit, ordinance or regulation; (ii) gain or attempt to gain unauthorized access to the Voiceitt Solution; or (iii) engage in commercial distribution of the Voiceitt Solution, or copy or create any derivative work of the Voiceitt Solution.
INTELLECTUAL PROPERTY
Voiceitt retains all worldwide intellectual property rights, title, and interest in the Voiceitt Solution, including its overall appearance and any text, graphics, designs, videos, interfaces, and underlying source files. You are permitted to use the Voiceitt Solution subject to the terms hereof but are not granted any ownership or other rights in the Voiceitt Solution or any other property of Voiceitt.
FEES
Use of the Voiceitt solution will be free of charge for the first 30 days after purchase; your credit card will be charged promptly after this free trial period has ended. The amount of the charge will be consistent with the subscription that you purchased in the RAZ Mobility online Shop.
REFUND AND CANCELLATION POLICY
If you cancel your subscription during the 30-day free trial period, you will not be charged any fees and no refund is necessary. If you purchased an annual subscription (rather than a month-to-month subscription), and you cancel the subscription within 20-days from the last day of the 30-day free trial period, you will receive a refund of $250.00. If you cancel your subscription more than 20 days after the last day of the 30-day free trial period, you will not receive a refund. If you purchased a monthly subscription of the Voiceitt Solution, and you cancel the service, you will not receive a refund for payments already made, however the Voiceitt Solution will be cancelled, and you will not be charged in the future.

We may disclose de-identified or aggregated information where it is not prohibited by applicable law, and we take commercially reasonable steps to maintain it in this form and to require recipients of it to do the same.
CHOICE AND CONTROL OF PERSONAL INFORMATION
We provide you with options and choices for how we use personal information, as described further in this section. In some jurisdictions, these options and choices may be enforceable as rights under applicable law.
Access, confirm processing, to know, portability, correction, and deletion. If you wish to access, confirm our processing of, know what, obtain a copy of (including for porting or transferring), correct inaccurate, or delete, personal information about you that we hold, you can do so through the RAZ Care app. If you are unable to access, confirm processing, know, port, correct, or delete certain personal information we have via the means described above, you can send us a request by using contact methods described at the bottom of this privacy policy.
Promotional email preferences. You can choose whether to receive promotional emails from us. If you receive promotional email from us and would like to stop, you can do so by following the directions in that message or by contacting us as described in the “Contact Us” section below. If you make a request to opt-out of promotional emails we may still send certain informational communications and product or service-related communications.
Do Not Sell or Share My Personal Information. Some laws define “sell” and “share” very broadly, and some of our data sharing described in this privacy policy may be considered a “sale” or “sharing” under those definitions. In particular, Third-Party Partners may collect identifiers, device information, commercial information, Internet and network activity, and geolocation data through our website and services, including as further described in the Cookies, Web Beacons, and Other Technologies section above.
If you do not wish for us to “sell” personal information, or “share” personal information for targeted advertising purposes, you can make your request to opt-out by sending an email to privacy@razmobility.com or calling 1-800-729-0083, and by following the instructions below for opting out of having personal information we collect from you used for targeted advertising. You should take both of these actions when making your request so that it can be honored both for personal information we collect about you, and for personal information that is collected automatically (such as via Technologies).
If you opt-out using these choices, we will take steps to stop disclosing personal information in ways that are considered a “sale” or “sharing” (for targeted advertising) for which opt-out rights are required under applicable law. However, we will continue to disclose personal information to service providers and others as allowed by applicable law. We do not knowingly sell or share personal information of minors under 16 years of age.

Email web beacons. Your email service may have settings that allow you to prevent the automatic downloading of images, including web beacons, which may prevent us from automatically collecting personal information via web beacons in emails.
Information about exercising your choices, agents, and verification. Except for the automated controls described above, if you send us a request to exercise your rights or these choices, to the extent permitted by applicable law, we may decline requests in certain cases. For example, we may decline requests where granting the request would be prohibited by law, could adversely affect the privacy or other rights of another person, would reveal a trade secret or other confidential information, or would interfere with a legal or business obligation that requires retention or use of the data. Further, we may decline a request where we are unable to authenticate you as the person to whom the data relates, the request is unreasonable or excessive, or where otherwise permitted by applicable law. If you receive a response from us informing you that we have declined your request, in whole or in part, you may appeal that decision by submitting your appeal using the contact method described at the bottom of this privacy policy.
You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights where permitted by law. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.
To provide, correct, or delete specific pieces of personal information we will need to verify your identity to the degree of certainty required by law. We will verify your request by asking you to send it from the email address associated with your account, the cell phone number associated with your account, or by requiring you to provide information necessary to verify your account.
You have a right to not be discriminated against for exercising your rights under applicable law, including where applicable, when making the requests noted above. We do not use or disclose sensitive personal information for purposes that require us to offer consumers a right to limit our uses or disclosures under California law.
RETENTION OF PERSONAL INFORMATION
We retain personal information for as long as necessary to provide the products and services and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, and for other legitimate and lawful business purposes. Because these needs can vary for different data types in the context of different services, actual retention periods can vary significantly based on criteria such as user expectations or consent, the sensitivity of the data, and our legal or contractual obligations. Notwithstanding the above, RAZ Mobility will delete customer account information associated with the RAZ Care app upon request. This is information that the customer provided within the RAZ Care app.
LOCATION OF PERSONAL INFORMATION
The personal information we collect may be stored and processed in your country or region, or in any other country where we or our affiliates, subsidiaries, or service providers process data, including for example, the United States of America, and Germany. We take steps with the intent of processing and protecting personal information as described in this privacy policy wherever the personal information is located.

We take what we believe to be reasonable and appropriate steps intended to help protect personal information from unauthorized access, use, disclosure, alteration, and destruction.
ADDITIONAL NOTICES ABOUT OUR PRACTICES
California’s “Shine the Light” law permits residents who have provided personal information to certain businesses to request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes. We do not disclose personal information to any third parties for their direct marketing purposes as defined by this law.
CHANGES TO THIS PRIVACY POLICY
We will update this privacy policy when necessary to reflect changes in our services, how we use personal information, or the applicable law. When we post changes to the privacy policy, we will revise the “Last Updated” date at the top of the privacy policy. If we make material changes to the privacy policy, we will provide notice or obtain consent regarding such changes as may be required by law.

This limited warranty is provided by RAZ Mobility, LLC (“RAZ Mobility”) to you as the original purchaser of any product that you purchase directly from RAZ Mobility or the original purchaser of the Lucia phone or any associated accessory that you purchased from a RAZ Mobility approved Partner (the “Products”). The list of approved RAZ Mobility Partners is provided at the end of this warranty policy
This limited warranty does not cover mobile wireless service provided by Red Pocket Mobile or other wireless providers and purchased through the RAZ Mobility website or the RAZ Mobility customer service center. Any problems that you may have with wireless service must be addressed with Red Pocket Mobile (1-888-993-3888) or other wireless providers. RAZ Mobility is not liable for any damages (direct or indirect) that you may experience as a result of service provided to you by Red Pocket Mobile.
RAZ Mobility warrants the Product to you against defects in materials or workmanship under ordinary consumer use for one year from the date of your original retail purchase from us. Ordinary consumer use does not include damage caused by accident, abuse, drops, misuse, fire, liquid contact, earthquake or other external causes. It also does not include damage caused by normal wear and tear or otherwise due to the normal aging of the Product. RAZ Mobility does not warrant that the operation of the Product will be uninterrupted or error free. If you have your Product fixed by anyone or any company other than RAZ Mobility this warranty is void.
This limited warranty applies only to Products purchased within the United States and Canada (the “Territory”). Replacement and repaired Products or parts will be shipped only to addresses within the Territory, and refunds will only be credited to accounts located within the Territory.
If the Product proves defective during the warranty period, and you follow the instructions that we provide to you for returning the Product, we will, at our option, take one of the following actions: (i) replace the Product with either a new or a refurbished Product that is the same or similar to the Product you purchased; (ii) repair the Product using either new or refurbished parts; or (iii) refund to you the purchase price of the Product. RAZ Mobility does not guarantee that any of these three actions will occur within a specific period of time. Generally, however, you can expect it to take approximately seven days from the day that we receive the Product.
There is no assurance, representation or warranty that any replacement Product will be identical to or will offer the same functionalities as the product returned to us. Technological advances and Product availability may result in your receiving a replacement Product with a lower selling price than the original Product you purchased. In all cases, Product comparability will be determined by us at our sole discretion.
This limited warranty also applies to any replacement product or part for the remainder of the original warranty period or for 90 days from the shipment to you, whichever period is longer. All Products or parts that you return to us, and for which we provide you a refund or replacement, will become our property upon receipt.
In order to obtain warranty service, you must provide proof that you purchased the product from RAZ Mobility or an approved RAZ Mobility partner.
To benefit from this Warranty Policy, you must first call RAZ Mobility at 800-729-0083. We will email you a pre-paid shipping label and ask for a credit card authorization equal in value to the cost of shipping the Product to RAZ Mobility. If, after evaluating the Product, we determine in our sole discretion that the Product is covered by this Warranty Policy, we will cancel the credit card authorization. On the other hand, if we conclude that the Product is ineligible for coverage, we will charge your credit card for the authorized amount. Products that are not covered by the Warranty Policy may still repaired at your expense.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, RAZ MOBILITY SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, ALL WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, AND RAZ MOBILITY DOES NOT WARRANT THAT THE OPERATION OF ANY PRODUCTS OR SOFTWARE COVERED UNDER THIS LIMITED WARRANTY WILL MEET YOUR REQUIREMENTS, WORK IN COMBINATION WITH ANY HARDWARE OR SOFTWARE APPLICATIONS OR THIRD PARTY SERVICES, BE UNINTERRUPTED, ERROR-FREE, OR WITHOUT RISK TO, OR LOSS OF, ANY INFORMATION, DATA, SOFTWARE OR APPLICATIONS CONTAINED THEREIN, OR THAT DEFECTS IN THE PRODUCTS OR SOFTWARE WILL BE CORRECTED. WHERE SUCH STATUTORY OR IMPLIED WARRANTIES CANNOT LAWFULLY BE DISCLAIMED, THEN TO THE EXTENT PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED IN DURATION TO THE DURATION OF THE EXPRESS LIMITED WARRANTY CONTAINED HEREIN AND THE REMEDIES OF REPAIR, REPLACEMENT, OR REFUND AS DETERMINED BY RAZ MOBILITY IN ITS SOLE DISCRETION SHALL BE THE EXCLUSIVE REMEDY OF THE CONSUMER. NO ORAL OR WRITTEN REPRESENTATIONS MADE BY RAZ MOBILITY OR ANY SELLER, RESELLER OR DISTRIBUTOR OF THE PRODUCTS, INCLUDING EMPLOYEES AND AGENTS THEREOF, SHALL CREATE ANY ADDITIONAL WARRANTY OBLIGATIONS, INCREASE THE SCOPE, OR OTHERWISE MODIFY IN ANY MANNER THE TERMS OF THIS LIMITED WARRANTY.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, RAZ MOBILITY SPECIFICALLY DISCLAIMS ANY AND ALL LIABILITY, WHETHER IN CONTRACT, TORT OR UNDER OTHER LEGAL THEORY (INCLUDING NEGLIGENCE), FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCTS, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR LOSS OF REVENUE OR PROFITS; LOSS OF BUSINESS; BUSINESS INTERRUPTION; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE ABILITY OR INABILITY TO USE THE PRODUCTS OR SERVICES PROVIDED UNDER THIS LIMITED WARRANTY. BY MAKING A CLAIM UNDER THIS LIMITED WARRANTY YOU ACKNOWLEDGE THAT YOU UNDERSTAND THE ABOVE DISCLAIMERS OF LIABILITY.
SOME STATES, PROVINCES OR JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR THE EXCLUSION OR LIMITATION ON THE LENGTH OF AN IMPLIED WARRANTY, OR THE LIMITATION OR EXCLUSION OF DAMAGES FOR PERSONAL INJURIES CAUSED BY NEGLIGENCE, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE OR JURISDICTION.

RAZ Mobility is confident that you’re going to love your phone and accessories, but just in case, we make returns simple. All phones and accessories sold by RAZ Mobility can be returned for a refund within 20 calendar days of the date that you received your order. During this 20-day period you may return your phone and accessories for any reason, as long as:
1) The phone and accessories are in like-new condition with no physical or water damage and in the manufacturer’s original packaging;
2) You include the original components including, but not limited to, the device, battery, charger, cable(s) and Quick Start Guide; and
3) You provide proof that you purchased the phone and/or accessories from RAZ Mobility.
You cannot return accessories alone, pursuant to this policy. In other word, you cannot decide to keep the phone but return the accessories (unless the accessory has a manufacturer’s defect covered by the Warranty). However, if you return the phone, you may also return the accessories that you purchased.
You will receive a full refund for the returned phone and accessories (if applicable) minus a $75.00 restocking fee. Shipping and Handling cost are not refundable. If you do not include all of the original components, such as the charger or cable, the restocking fee will be $100.00. You are responsible for the shipping cost.
