The RAZ Emergency Service is managed through the caregiver online portal.  The caregiver is able to input the user’s basic health information.  This health information will be provided automatically to the emergency dispatcher during a call. 

In addition, the caregiver will be able to designate up to three (3) emergency contacts who can receive text message alerts when the user places an emergency call.  The text message will state that the emergency service has received an alarm from the user and that emergency contacts have been contacted.  It will further ask “[w]ould you like us to contact emergency services?”  The emergency contact(s) can interact with the emergency dispatcher via text message to determine whether emergency services should be contacted.

Here is an example of a call to the RAZ Emergency Service: The user taps the emergency button on the RAZ Memory Cell Phone.  The phone asks the user to confirm that they wish to call the Emergency Service; the user taps “Yes”.  The emergency dispatch agent answers the call and asks for the nature of the emergency.  At the same time, text messages are sent to three (3) emergency contacts.  The user explains that someone is trying to break into his house.  The emergency dispatch agent relays this information by text message to the emergency contacts who instruct the emergency dispatch agent not to call 911 because their father actually lives in a secure senior living facility and frequently makes this exact claim in the middle of the night and that he gets confused.  One of the emergency contacts volunteers that they will call someone at the senior living facility to visit him and calm him down.  911 emergency service is not contacted, and the emergency call is ended.

In the event of a real emergency, for example a heart attack, the emergency dispatcher can provide the user’s basic health information to 911 emergency service.  The emergency dispatcher will also have access to the user’s location information through the Phone’s GPS, assuming that there is no interference with the GPS signal.

To protect our company from liability, purchasers of the RAZ Emergency Service will need to waive their right to sue RAZ Mobility for reasons related to the performance of the Service.  In order to dot all of the i’s and cross all of the t’s, you will also need to provide us with either a Power of Attorney or a court order establishing a Guardianship.  One of these documents is necessary in order to establish that you have the authority to waive the user’s right to sue RAZ Mobility.  We apologize for the inconvenience, but you have our litigious society to thank for this precaution.  If you have any concerns, please call customer support at 800-729-0083.

These Terms and Conditions apply to the RAZ Emergency Service offered by RAZ Mobility, LLC (“RAZ Mobility”).

If you are purchasing the RAZ Emergency Service on behalf of someone else, you represent and warrant that you have the authority to do so and that you can accept and agree to these Terms and Conditions on their behalf.

CONTENT AND DATA You represent and warrants that you own all right, title, and interest in and to the data, content, or other materials (“End User Content”) that you provide to RAZ Mobility for the purpose of providing the RAZ Emergency Service.  By uploading the End User Content or allowing RAZ Mobility and its subcontractors to access such End User Content, you hereby grant and will grant RAZ Mobility and its subcontractors a nonexclusive, worldwide, royalty free, fully paid up, transferable, and sublicensable license to use, copy, display, upload, perform, distribute, store, modify, and otherwise use the End User Content for the limited purpose of providing the RAZ Emergency Service.

DISCLAIMER OF WARRANTY THE RAZ EMERGENCY SERVICE IS FURNISHED AS IS, WHERE IS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE.

WAIVER OF LIABILITY IN CONSIDERATION FOR RECEIVING THE RAZ EMERGENCY SERVICE, YOU RELEASE FROM LIABILITY AND WAIVE YOUR RIGHT TO SUE RAZ MOBILITY AND ITS EMPLOYEES, OFFICERS AND SUBCONTRACTORS (COLLECTIVELY, “PROVIDERS”) FROM ANY AND ALL CLAIMS, INCLUDING THE PROVIDERS’ NEGLIGENCE, RESULTING IN ANY PHYSICAL INJURY, ILLNESS (INCLUDING DEATH) OR ECONOMIC LOSS THAT YOU MAY SUFFER IN CONNECTION WITH THE RAZ EMERGENCY SERVICE.

RESTRICTIONS You will not engage in, attempt to engage in, or permit or assist others in engaging in, any of the following prohibited activities: (i) use any software, script, code, device, crawler, robot, or other means not provided by Company or its subcontractors to access the RAZ Emergency Service; (ii) circumvent, disable, or otherwise interfere with security-related features on the RAZ Emergency Service; (iii) modify, adapt, translate, reverse engineer, decipher, decompile, or otherwise disassemble any portion of the RAZ Emergency Service; (iv) access or use the RAZ Emergency Services in any manner that may damage, disable, unduly burden, or impair any part of the RAZ Emergency Service, or any servers or networks connected to the RAZ Emergency Service; (v) interact with the RAZ Emergency Service in a manner which is fraudulent, libelous, abusive, obscene, profane, harassing, or illegal; (vi) use the RAZ Emergency Service for any illegal purpose or in violation of any law, statute, rule, permit, ordinance or regulation; (vii) gain or attempt to gain unauthorized access to the RAZ Emergency Service; (viii) interfere or attempt to interfere with the RAZ Emergency Service provided to any user or network, including, without limitation, via means of submitting a virus to the RAZ Emergency Service, spamming, crashing, or otherwise; (ix) engage in commercial use or distribution of the RAZ Emergency Service, or copy or create any derivative work of the RAZ Emergency Service; (x) use the RAZ Emergency Service in any way that infringes or misappropriates any third party’s rights, including intellectual property rights, copyright, patent, trademark, trade secret, or other proprietary rights, or rights of publicity or privacy; or (xi) use the RAZ Emergency Service for the benefit of any third party.

REFUND POLICY If you purchased an annual subscription to the RAZ Emergency Service and you return the RAZ Memory Cell Phone within the 20-day return period, you will receive a refund of $40.00 on the annual subscription amount and your RAZ Emergency Service will be cancelled.  If you purchased a monthly subscription of the RAZ Emergency Service and you return the RAZ Memory Cell Phone within the 20-day return period, you will not receive a refund for payments made for the RAZ Emergency Service, however the RAZ Emergency Service will be cancelled.

CANCELLATION POLICY You may cancel your RAZ Emergency Service at any time, however you will not receive a refund for payments already made for the RAZ Emergency Service except as provided in the paragraph above titled “Refund Policy”.

APPLICABLE LAW

By purchasing the RAZ Emergency Service, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Virginia, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between you and RAZ Mobility.

    We realized the importance of a 911 intercept service when Mom called 911 nine times one day. She could not explain where she was and it took the 911 operations a while to figure out what was happening. The Emergency Service is very important and the facility was happy to have a solution. This allows her to keep her phone to contact family without risk of burdening the local 911 system. Since then, it’s worked well and when the family is alerted, we can call the facility and ask someone to check on her. The service gives us peace of mind and avoids false alarms.

    This was the best solution for my sister’s tendency to press everything on the home screen if she was unable to contact me or other relatives. Still think that bright red banner should be smaller and less conspicuous.

    He has not had to use this yet, but I really like the idea that he will not be calling 911 and tying up their time. Instead he will be calling an emergency line that has his information, as well as my phone number. If it is an accidental call, or not a real emergency the emergency service will let me know he called and if he needs something. I just really like the option of not disturbing 911, unless it is truly needed. My husband with FTD is not mentally able to make decisions about emergencies now.
